Terms of Service

Public offer for access to the Risovator service

Version of 30 September 2026

This is a translation of the Russian original. If the texts differ, the Russian version prevails.

1. General provisions and definitions

1.1. This document is a public offer made by the individual entrepreneur Pavel Evgenievich Shiriaev (Russian taxpayer number (INN) 422372839869, registration number (OGRNIP) 317420500026815, the “Provider of the Service” or “we”) to any person with full legal capacity to enter into an agreement for access to the Risovator service (the “Agreement”) on the terms set out below (Article 437(2) of the Civil Code of the Russian Federation, the “Civil Code”).

1.2. In this document:

  • Service means the Risovator software service available at https://risovator.com, including the user account area at https://risovator.com/app, the HTTP API (https://risovator.com/v1/…) and the MCP server for connecting AI assistants (https://risovator.com/mcp).
  • User means an individual aged 18 or over with full legal capacity who has registered an account in the Service. A person who registers an account for a company or a sole proprietor confirms that they are authorised to act on its behalf.
  • Model means a neural network made by a third-party developer (an “AI Provider”) and connected to the Service to create images or videos.
  • AI Provider means the developer of a Model: Google LLC (Gemini and Veo models) or OpenAI, L.L.C. (GPT Image models).
  • Request means the text description (prompt), the settings (Model, format, video length) and, if the User chooses, an image uploaded by the User, on which a Generation is based.
  • Generation means creating one image or one video with the selected Model based on the User’s Request.
  • Result means the image or video created by a Generation.
  • Balance means the amount in Russian rubles recorded in the Service that the User has paid in advance for Generations.
  • API Key means a secret key created by the User in their account that lets the User’s programs and AI assistants access the Service on the User’s behalf.

1.3. The relationship between the parties is governed by the laws of the Russian Federation, including, where the User is a consumer, Russian Federation Law No. 2300-1 of 7 February 1992 “On Consumer Rights Protection” (the “Consumer Protection Law”). Nothing in this document limits consumer rights granted by law.

1.4. This document is published in Russian, English and Spanish. The English and Spanish versions are translations. If they differ from the Russian version, the Russian version prevails.

2. Subject of the Agreement

2.1. We let the User create images and videos in the Service with AI Providers’ Models based on the User’s Requests, and the User pays for each Generation at the price shown in the Service when it is started.

2.2. As of the date of this version, the following Models are connected to the Service:

  • images, OpenAI: GPT Image 2 in Low, Medium and High modes;
  • images, Google: Nano Banana (Gemini 2.5 Flash Image), Nano Banana 2 (Gemini 3.1 Flash Image), including the 2K size, and Nano Banana Pro (Gemini 3 Pro Image);
  • videos, Google: Veo 3.1 Lite, Veo 3.1 Fast (including 1080p) and Veo 3.1.

Images come in 1:1, 16:9 and 9:16 formats, videos in 16:9 and 9:16 formats, 4, 6 or 8 seconds long. All of the Models listed accept the User’s image as part of a Request. The current list of Models, formats and prices is shown on the Service website and in the user account and may change as described in section 14.

2.3. The Service can be accessed through the user account and also through the HTTP API and the MCP server with an API Key. Generations started in any of these ways are paid from the same Balance at the same prices.

2.4. In the user account, the User can see the history of Generations, favourites, export the list of Generations, view spending and, if they wish, show a Result in the Service’s public gallery.

2.5. We do not develop the Models. Each Generation is performed by an AI Provider’s Model: the Request is sent to the AI Provider through our generation server in Germany, and the Result is saved in the Service’s storage and made available to the User.

3. Acceptance and conclusion of the Agreement

3.1. This offer is accepted by registering an account in the Service and/or topping up the Balance (Article 438(3) of the Civil Code). From acceptance, the Agreement is deemed concluded in writing (Article 434(3) of the Civil Code).

3.2. By accepting, the User confirms that they are 18 or over, have full legal capacity, have read these Terms and accept them in full.

3.3. An account can only be registered if the User consents to the processing of their personal data (section 13).

4. Account

4.1. To register, the User provides an email address and a password of at least 8 characters. The User must provide a working email address that belongs to them: it is used to log in, reset the password, send messages and verify the User’s identity when they contact us, including about refunds.

4.2. The User must keep the password secret. Actions taken in the Service after logging into the User’s account are deemed to be taken by the User unless the User proves otherwise.

4.3. A forgotten password is reset through a link that the Service sends to the account email address. When the password is changed through such a link, all open sessions of the account are ended.

5. Prices

5.1. The price of each Generation is shown in rubles on the Service website and in the user account (on the button that starts the Generation) before the Generation is started. The price depends on the Model, the format, the video length and whether the User’s image is included in the Request (for OpenAI Models, an extra 1 ₽).

5.2. We may change prices by publishing the new prices in the Service. A Generation is charged at the price in effect when it is started. Price changes do not affect Generations started before the change.

5.3. At the User’s choice, prices and the Balance can be displayed in US dollars or euros. Such amounts are for reference only and are calculated at the official exchange rate of the Central Bank of the Russian Federation; all payments under the Agreement are made in rubles.

6. Payment and Balance

6.1. Generations are paid for by topping up the Balance in advance in the user account. A single top-up can be any whole-ruble amount from 500 ₽ to 100,000 ₽.

6.2. Payments are accepted by the payment service Prodamus LLC (ООО «Продамус») on its payment page, using the methods offered there, including bank cards (cards issued outside Russia included) and the Faster Payments System (SBP). Card details are entered on the Prodamus page; they are not passed to us and we do not store them.

6.3. If the User enters a top-up amount in US dollars or euros, it is converted into rubles at the official exchange rate of the Central Bank of the Russian Federation at the time the payment is created, and the payment is made in rubles. The User’s bank converts the currency of the User’s account at its own rate; we do not cover exchange differences or fees charged by the User’s bank.

6.4. Funds are credited to the Balance at 1 ₽ paid = 1 ₽ of Balance once we receive a successful payment notification from Prodamus. We do not apply bonuses, discounts or fees to top-ups.

6.5. The Balance is an advance payment for our services. It is not electronic money, cannot be transferred to other persons and does not earn interest. The Balance does not expire.

7. How the services are provided and charged

7.1. When a Generation is started, its price is deducted from the Balance before the Model is called. If the Balance is insufficient, the Generation is not started.

7.2. If a Generation does not produce a Result, whether because of a technical failure, the Model refusing the Request under the AI Provider’s rules, an error saving the Result or any other reason, the amount deducted is automatically returned to the Balance in full. If an image is not created within 15 minutes, or a video within 45 minutes, after it is started, the Generation is treated as failed and its price is automatically returned to the Balance at the next check, which runs every 5 minutes.

7.3. A Generation service is deemed provided when the Result has been saved in the Service and is available to the User in the user account or through the API. From that moment, the amount deducted is payment for a service provided.

7.4. Results are created automatically by the Model. We do not guarantee that a Result will meet the User’s expectations, including as to composition, style, accuracy of text in the image or likeness to the uploaded photo. A Result not matching the User’s subjective expectations is not a defect of the service, provided the Result was created by the selected Model based on the User’s Request.

7.5. If a Result has a technical defect (the file will not open, is empty or is corrupted), the User may report it to phn999@ya.ru from the account email address. We will review the report and, if the defect is confirmed, return the price of that Generation to the Balance. This does not limit the consumer’s other rights under Article 29 of the Consumer Protection Law.

7.6. To protect against accidental loops in the User’s programs, the Service limits how often Generations can be started from one account. We may temporarily pause the start of new Generations when technically necessary; in that case nothing is deducted from the Balance.

7.7. We recommend that the User saves Results to their own device. We do not guarantee that Results and uploaded images will be stored in the Service indefinitely, and we may set a storage period by publishing it in these Terms.

8. Refunds

8.1. The User may withdraw from the Agreement at any time and request a refund of the unused Balance (Article 32 of the Consumer Protection Law, Article 782 of the Civil Code). Amounts deducted for Generations that produced a Result are payment for services actually provided and are not refundable, except as provided in clause 7.5 and by law.

8.2. To request a refund, the User sends a request to phn999@ya.ru from the email address used to register the account. The request must state the account email address, the User’s full name, and the amount to be refunded or that the entire remaining Balance is to be refunded.

8.3. We refund the money within 10 days of receiving the request (Article 22 and Article 31(1) of the Consumer Protection Law) by the same method used for payment, through Prodamus to the card or account from which the payment was made. If a refund by that method is not possible, we will ask the User for bank account details for a transfer. How long the funds take to reach the User’s account after they are sent depends on the rules of the User’s bank and the payment system.

8.4. A refund cannot exceed the amounts actually paid by the User and is made in rubles. If the Balance was topped up with several payments, the refund may be made in parts against each payment.

8.5. After receiving a request to refund the entire remaining Balance, we may pause the start of new Generations on the account until the refund is completed. Once the entire remaining Balance has been refunded, the Agreement is terminated; the account can be used again after a new top-up.

9. Rights to Results

9.1. We do not claim any rights to Results created by the User. To the extent we may acquire any rights to a Result, we grant the User the right to use it in any lawful way, including for commercial purposes, worldwide, without time limit and without additional payment.

9.2. Results are also used subject to the AI Providers’ terms: under OpenAI’s terms, the user owns the output created by the model, and OpenAI assigns to the user any rights it may have in that output; under Google’s terms, Google does not claim ownership of content generated with the Gemini API. The User agrees to follow the AI Providers’ acceptable use rules (OpenAI Usage Policies, Google Generative AI Prohibited Use Policy).

9.3. We do not guarantee that a Result is protected by copyright, is unique or does not match results produced for other users of the Models, or that a Result does not infringe third-party rights (including rights in trademarks, works or a person’s image). The User is responsible for deciding whether a Result can be used before using it.

9.4. The User grants us the right to store Requests, uploaded images and Results and to pass Requests and uploaded images to AI Providers to the extent necessary to provide the services under the Agreement.

10. Uploaded images and acceptable use

10.1. The User may upload images in JPG, PNG and WEBP formats up to 10 MB only if they hold the necessary rights to them. If an image shows a person, the User guarantees that they have that person’s consent to use their image, including passing it to AI Providers and creating new images and videos from it (Article 152.1 of the Civil Code), and, for images of minors, the consent of their legal guardians.

10.2. The User must not use the Service to create, upload or distribute:

  • material that breaks Russian law, including extremist and terrorist material and material promoting war, violence, drugs or suicide;
  • pornographic material, and any sexual material involving minors or persons who appear to be minors;
  • images and videos of a real person without their consent, including fake images and videos (deepfakes) intended to deceive, defraud, mislead, discredit or extort;
  • material that infringes copyright or related rights, trademark rights or other third-party rights;
  • forged documents, banknotes or other material for unlawful purposes;
  • defamatory or insulting material;
  • material prohibited by the AI Providers’ acceptable use rules.

10.3. The User must not attempt to bypass the Service’s technical limits, gain access to other people’s accounts or data, disrupt the Service or overload it.

10.4. A Model may refuse a Request under the AI Provider’s rules; in that case the price of the Generation is returned to the Balance (clause 7.2).

10.5. If clauses 10.1–10.3 are breached, we may remove a Result from the public gallery, revoke API Keys and block the User’s account, and pass information to the competent authorities where required by law. The unused Balance of a blocked account is refunded at the User’s request under section 8.

10.6. The User is solely responsible for the content of Requests and uploaded images and for how Results are used. If a third party brings claims against us arising from the User’s breach of clauses 10.1–10.3, the User will compensate us for the resulting losses to the extent permitted by law.

11. Public gallery

11.1. The User’s Results are never published without the User’s decision. A Result appears in the public gallery on the Service website, open to all visitors, only after the User clicks “Show in gallery” for that Result.

11.2. The gallery shows the Result, the Model name, the format and the text of the Request. The email address and other account details are not shown in the gallery.

11.3. The User can remove a Result from the gallery at any time by clicking the same button again. We may remove any Result from the gallery without giving reasons.

12. API Keys and AI assistants

12.1. The User can create up to 20 active API Keys in the user account. An API Key is shown once, when it is created; the Service stores only its irreversible fingerprint.

12.2. The User must keep API Keys secret and must not share them with third parties. Generations started with the User’s API Key, including by programs and AI assistants (for example, Claude) to which the User has given the key, are deemed started by the User and are paid from the User’s Balance.

12.3. The User can set a daily spending limit for each API Key; once it is reached, no more Generations are started with that key. If the User suspects that an API Key has become known to others, the User must delete it in the user account. We are not liable for charges made with an API Key that became known to third parties through no fault of ours.

13. Personal data

13.1. We are a personal data operator (registration number 54-25-056731 in the register of operators kept by Roskomnadzor, the Russian data protection authority) and process the User’s personal data in accordance with the Personal Data Processing Policy (https://pavelshiriaev.ru/politika/, in Russian) and on the basis of the Consent to Personal Data Processing (https://pavelshiriaev.ru/soglasie-obrabotka/, in Russian) that the User gives when registering.

13.2. To provide the services, Requests and uploaded images are passed to the AI Providers, Google LLC (Gemini API) and OpenAI, L.L.C., through our generation server in Germany; images and videos are stored in the cloud storage of Yandex.Cloud LLC (ООО «Яндекс.Облако»); payments are processed by Prodamus LLC; the Service’s emails are sent through the Mail.ru email service (VK LLC, ООО «ВК»). The full list of recipients, the terms of cross-border transfer and retention periods are set out in the Policy.

14. Liability and limitations

14.1. The Service is provided as it exists at the time of use (“as is”). We take reasonable steps to keep the Service running, but do not guarantee that it or any particular Model will be available without interruption. AI Providers may change, restrict or discontinue Models; we may change the list of Models, formats and features of the Service. If a Model is removed from the Service, the User can use the Balance for other Models or have the remaining Balance refunded under section 8.

14.2. We are not responsible for the content of Results created from the User’s Requests, for how the User uses them or for decisions the User makes based on them.

14.3. Our liability for improper performance of a particular Generation is limited to the amount the User paid for that Generation, to the extent permitted by law. This limitation does not apply where the law, including the Consumer Protection Law, does not allow liability to be limited, or to intentional breach of obligations (Article 401(4) of the Civil Code).

14.4. Neither party is liable for failure to perform its obligations caused by force majeure (Article 401(3) of the Civil Code), including failures and restrictions of AI Providers, payment systems and communication networks not caused by the parties, and acts of public authorities.

15. Changes to the Terms, term and termination

15.1. We may change these Terms by publishing a new version, with its date, at https://risovator.com/ru/terms/. The new version applies to Generations started after it is published. If the User does not agree with the new version, the User may stop using the Service and have the unused Balance refunded under section 8.

15.2. The Agreement remains in force until terminated. The User may terminate the Agreement at any time under section 8. We may discontinue the Service by giving Users advance notice on the Service website and by email; in that case the unused Balance is refunded at the User’s request under section 8.

15.3. Messages to the User are sent to the account email address. Messages to us should be sent to phn999@ya.ru.

16. Disputes

16.1. The parties will try to resolve disputes through negotiation. The User may send a claim to phn999@ya.ru or by post to our address in section 17. We will review the claim and reply within 10 days of receiving it.

16.2. If a dispute is not resolved, it will be heard by a court in accordance with the laws of the Russian Federation. A User who is a consumer may, at their choice, file a claim with the court at our location, at the consumer’s place of residence or stay, or at the place where the Agreement was concluded or performed (Article 17 of the Consumer Protection Law). For a User who is a consumer, sending a claim first is not a condition for going to court.
